    The original FMLA included an understanding that not all minors will be cared for by a biological parent and that some caregivers will not have formal rights of custody or similar certifications.  It did so by mandating leave for persons “in loco parentis,” that is, adults who provide day-to-day care and financial support for minors.

    On July 8, 2010, a new federal regulation went into effect that may have far-reaching implications for companies that have contracts with the federal government.  As of that date, contracting agencies must include in solicitations and contracts of at least $25,000 a clause requiring certain contractors and first-tier subcontractors to report at http://www.ccr.gov the names and total compensation of each of the five most highly compensated executives for the contractor’s or subcontractor’s preceding fiscal year.

David S. Fortney, Esq. will serve as a panel moderator at the 2010 National Conference on Equal Employment Opportunity Law in San Antonio, Texas, presented by the American Bar Association Section of Labor and Employment Law. Focusing on the legal and policy developments in Equal Opportunity, the conference will provide insights for trial strategy on workplace claims and litigation.

Mr. Fortney’s panel is titled Beginning “The Work of Remaking America”: The Obama Administration’s Legislative and Regulatory Initiatives. Panelists will include Randy Johnson of the U.S. Chamber of Commerce and Nancy Schiffer of AFL-CIO. This discussion will address the Obama Administration’s initiatives and legislation that are important to EEO practitioners. Panel content will include a review of major legislative and policy implications of key workplace initiatives, such as the Paycheck Fairness Act and the Family and Medical Leave Act. The panel will examine various initiatives affecting federal agency compliance programs, including those at the EEOC and DOL.   In addition, the panels will address issues affecting federal contractors and legislation simplifying the pleading standard in federal cases, and will review pertinent cases and precedents in labor and employment law.
