			<title>DOL Extends Comment Period for Proposed FMLA Rule</title>

On February 15, the Department
of Labor (DOL) published a Notice of Proposed Rulemaking (storage/fortneyscott/documents/fmla_nprm_2012.pdf)
(NPRM) to implement statutory amendments to
the Family and Medical Leave Act (FMLA) that expand military family leave provisions and
incorporate a special eligibility provision for airline flight crew employees.  On April
12, only four days in advance of the April 16 deadline for submitting comments
on its proposed rule, the Department of Labor announced that it is extending the deadline (storage/fortneyscott/documents/fmlacomment.pdf) to allow two more weeks.  Comments will now be due on April 30, 2012.

			<title>EEOC Issues Final Rule Under ADEA</title>

By: final rule (storage/fortneyscott/documents/adearfoa.pdf) amending the regulations under the Age Discrimination in Employment Act (ADEA).  The rule is effective April 30, 2012.  The rule addresses the  reasonable factors other than age  (RFOA) defense available to employers in disparate impact age cases to conform with two U.S. Supreme Court decisions that recognized ADEA disparate impact claims and put the burden on employers.

At the end of 2011, the DOL-approved Forms issued for use at
various stages of the FMLA Request-Certification-Designation process expired by
operation of law.  That left covered
employers in something of a limbo, wonder whether the expired forms continued
to meet DOL requirements.  The indecision
is over.
