Universities have unique challenges in OFCCP compliance. Although many of the same requirements for supply and service contractors apply in the university setting, there are also innate differences. In fact, OFCCP Director Craig Leen has indicated that the higher education community can expect a guidance document in FY 2019 to help navigate these unique challenges. Some unique attributes for universities include AAP establishment structure, complex faculty compensation systems, and limitations with applicant tracking. When a university receives a scheduling letter, there are often questions regarding what department or campus is truly being audited by OFCCP. Craig Leen has suggested that universities should consider Functional AAPs (FAAPs). The session will outline the options for AAP audit submissions in light of possible new OFCCP guidance, as well as case studies for consideration on the approach for OFCCP submission. Universities also have some of the most complex and unique compensation systems in light of the variety of faculty member specialties or research grants. Panelists will discuss the challenges in reviewing pay equity given the nuances related to a faculty compensation. Finally, Universities face some practical challenges with attracting, recruiting, and record retention for specialized open positions. Case studies will be discussed with the audience to determine approaches for submitting and responding to OFCCP.
