Susan Warshaw Ebner
Susan Warshaw Ebner is a Shareholder at Fortney & Scott, LLC. Her practice concentrates on advising and representing small, mid-size and large businesses, as well as non-profit and consortium clients, on a broad spectrum of Federal, state and local government contract and compliance matters, including bid protests, small business size protests and appeals, contract procurement and administration, supply chain risk, cyber security, research and development, claims, audits, investigations, formal and informal dispute resolution, other transaction agreements, technology investment agreements, grants and cooperative agreements. She has represented clients in a variety of courts and forums, including the U.S. Court of Federal Claims, U.S. Government Accountability Office, U.S. Small Business Administration Area Office and Office of Hearings and Appeals, Boards of Contract Appeals, U.S. District and Appellate Courts, and state courts.
Previously, as a government attorney, Ms. Ebner advised and represented the Department of the Navy, the Department of Defense and the U.S. Office of Personnel Management in complex litigation before Federal District and Appellate courts, administrative boards and the U.S. Court of Federal Claims. Ms. Ebner was also appointed as a Special Assistant United States Attorney for the Northern District of Florida. In addition to her government and private practice experience, Ms. Ebner was in-house counsel at Cincinnati Bell Incorporated and its spin-off, Convergys Corporation, and Chief Counsel at NCR Government Systems Corporation.
Ms. Ebner is a member of the Bars of the District of Columbia and Commonwealth of Virginia, American Bar Association Public Contract Law Section (ABA PCLS), Boards of Contract Appeals Bar Association, Inc., and U.S. Court of Federal Claims Bar Association. At the ABA PCLS, she is the Section Vice Chair; Co-Chair of Publications Board; Co-Chair of the Section Liaisons Committee; and Member, Section Finance Committee. She also is Co-Chair of the Cyber Legal and Policy Committee of the National Defense Industrial Association (NDIA) Cyber Division.
Among her numerous professional accolades, Ms. Ebner previously served as President of the Boards of Contract Appeals Bar Association, Inc. (2010); President of Women In Defense, A National Security Organization and member of the Board of Directors of the National Defense Industrial Association (2007-2009); and on the Advisory Council of the U.S. Court of Federal Claims. Ms. Ebner was named a Fellow of the American Bar Foundation (2013 to present), served on the ABA PCLS Council (2013 to 2016), received ABA PCLS Section Chair Special Recognition Awards (2014, 2016, 2018), and was recognized for her work as Co-Chair of the Acquisition Reform and Emerging Issues Committee, which won the ABA PCLS Committee of the Year Award (2013). She received the Life Service Award from the Boards of Contract Appeals Bar Association (2010), was named to the BTI Client Service All-Star Team for Law Firms (2006), and received the Department of the Navy Meritorious Civilian Service Award (1987).

She has authored numerous articles and advisories on government contract and litigation topics and lectures frequently for professional groups and trade associations on issues arising in these areas. She holds a Bachelor's degree in English, with a concentration in Law and Society, from Cornell University College of Arts and Sciences and a law degree from Cornell Law School.
