The Department of Labor has issued a new Guide to the Family and Medical Leave Act (“FMLA”), designed to provide employees with a simpler, more “case-based” explanation of the many aspects of the law. The emphasis is on plain language and realistic situations, even including a number of “step-by-step” logic trees to guide an employee through the entire FMLA process, along with clear definitions of the essential terms. The Guide is likely to be a useful training tool for employers.
In addition, a new Directive is expected requiring employers to display the FMLA poster in all places of business, even those that have no workers eligible for FMLA leave. A new poster is being planned but there is no need to replace the existing poster.
